  • 1. OWNERSHIP – LEGAL INFORMATION

This website “www.jackbeds.com” (“the website”) is owned by JACKBEDS COMERCIO ELECTRONICO COLCHOES S.L. commercially known as “Jack Beds” (“Jackbeds” or “we”), a company legally constituted under Spanish law, with registered office at Calle Travessera de Gracia 165, (08012 Barcelona), with N.I.F. No. B66975798 and registered in the Mercantile Registry of Barcelona.

  • 2. OBJECT

The purpose of this website is the online sale of Jack Beds products to final consumers and for domestic use. If you are a professional or company, please write to us at comercial@jackbeds.com.

  • 3. ACCEPTANCE AND INTEGRITY

The access and use of our Website, as well as its information, services and contents are subject to the applicable regulations and the provisions established in these conditions and in the policies of the Website.

Users of this website (“User/s”) acknowledge and agree to have read and understood the Conditions of Use and Sale and the Privacy and Cookies Policies. By using our website, the User expressly acknowledges and agrees to be bound by its compliance to the extent that they are applicable.

The illegality, invalidity or ineffectiveness of any of the provisions of the conditions and policies of the Website will not affect the effectiveness of the rest. These provisions must be replaced or integrated with others that, being in accordance with the law, respond to the purpose of the replaced ones. TERMS OF SALE

The Conditions of Use form an integral part of these Conditions of Sale and all its clauses must be understood as incorporated in these Conditions of Sale.

  • 2. TERMINATION

The contractual relationship will end automatically without notice of resolution being necessary and without compensation of any kind if the User fails to comply with any provision of the conditions and policies of the Website.

  • 3. TERRITORIAL AND SUBJECTIVE SCOPE

On the one hand, this Website only allows sales in Spanish territory, with the exception of the territories of the autonomous communities of the Canary Islands and the autonomous cities of Ceuta and Melilla. Shipping to the Balearic Islands implies the payment of a supplement for shipping costs as detailed below.

On the other hand, you can only purchase products through this Website if you are of legal age and have full legal capacity. Otherwise, you must refrain from placing any order. By confirming an order, the User declares and guarantees that he is of legal age and has sufficient legal capacity to contract.

  • 4. PRODUCTS AND PHOTOGRAPHS

The products offered on the Website will be those determined by Jack Beds at all times. The products may only be intended for domestic use.

The user must, in any case, and prior to purchasing an item from those marketed by Jack Beds, make sure that it is the right one for the use you want to give it.

If required by the User, Jack Beds can provide guidance electronically, for example through our rest advisor, on the different products that it sells on the Website without this being considered advice on issues health and wellness.

In any case, Users will find descriptive sheets of the available products on the Website. Jack Beds is not responsible in any case for possible claims arising from a use other than that for which the Jack Beds product is designed.

The User acknowledges having been informed by Jack Beds through these conditions at the time of validating the firm order about the different specific general warnings related to the purchase of rest items in general.

In particular, but not limited to, the most relevant warnings are detailed below:

  • A mattress, textile piece or pillow are finished products with fiber load, seams and flexible fabrics, for which the indicated measurements are always indicative; Any excess height-width-length between +/- 2-3 cm is considered acceptable;
  • The bed bases may have dimensions that are somewhat different from the commercial reference depending on the side finishes they have –for example, models with trims and/or padding–. Variations between 1-1.5 cm height-width-length are considered acceptable;
  • All mattresses, after the first few nights, "take the shape" of the user; the acceptable sag corresponds to 20% of the total height of the mattress; normal phenomenon of adaptation signal of the mattress, this sinking does not modify in any way the qualities of comfort and solidity and therefore does not affect the guarantee;
  • It is advisable to buy the global base set plus mattress at Jack Beds to ensure their compatibility (to avoid possible risks of sinking or deformation of one of the pieces or the set);
  • The pistons (hydraulic and metallic compasses) of the folding beds are also designed to work with minimum and maximum forces; a new Jack Beds mattress with an old mattress or one acquired from another brand can cause a malfunction due to incompatibility;
  • The bed bases with motors are delivered with cable control; wireless controllers, if available, are optional and are listed for additional reference;
  • Electric bed bases are always delivered with two motors; Bed bases with additional motors (for articulation or massage) are listed in the product description or as an additional specific reference;
  • Never sit, jump or put pressure on a plane of the bed base when it is articulated, it is not prepared for this use; the same on the top of a folding sofa when it is in the open position;
  • All the articulated bed bases or folding bed covers can cause some minimal rubbing "noises" at a given moment; a silicone-based spray must be used to keep it in optimal condition;
  • The technical and internal design of the mattresses is the sole responsibility of the manufacturer: in the case of special measures, the mattresses can be designed with several blocks of the chosen material and not in a "monobloc" way, which does not affect their qualities or their durability or legal guarantee;
  • Oxygen and ozone can damage latex; it is recommended not to expose it to the air or the sun;
  • It is advisable not to handle the mattress or pillows outside their cover, unless it is absolutely essential; due to its sponginess it is sensitive to tearing;
  • Never keep a folding sofa with the lid down and without a mattress on it; the pressure exerted by the pistons and compasses can cause an inopportune opening and by surprise, and can cause injuries due to a strong blow to the user;
  • A mattress should not be folded once unpacked to avoid breakage in the foams and/or significant damage to the springs;
  • All foams change color over time to completely different shades in some cases; normal phenomenon that does not modify the quality of comfort, of the material or the solidity of the whole, and therefore does not affect the guarantee;
  • The climatic conditions, humidity, insufficient ventilation of the room, type of base used (hermetic and/or varnished), as well as users with high perspiration, can cause the formation of mold, which is in no case covered by the garanty of the product.

Finally, note that we use photographs and descriptions to provide an illustrative and approximate image of the products, in order to provide Users with an overview of the product, without implying their accuracy. For example, we do not guarantee that the appearance will be exactly the same as that shown in the photograph.

  • 5. PURCHASE PROCESS

Once the selection of the desired product has been made, the User will access a screen that provides general information about the product, price, shipping, return and guarantee (“Shopping Cart”).

Subsequently, to complete the order it will be necessary for the User to register as a registered User of the Website or to provide all the information required on the Website to complete their order or, where appropriate, access as a registered User with your username and password.

  • 6. ORDERS

The confirmation of the order by the User constitutes a contractual offer to purchase the product in question. The offer will be perfected at the time that Jack Beds confirms the order by sending a confirmation email together with the corresponding payment receipt indicating the amount delivered at the time of signing the order, breaking down applicable taxes such as VAT and other expenses (for example, shipping costs if any) and informing about the shipping method.

Jack Beds reserves the right to reject firm order(s). In this case, the User would be informed by email to the address provided within a maximum period of 3 business days from the date of the order placed. If the User does not make another order to replace the rejected one, Jack Beds will return to the User the amount initially paid on account by bank transfer, canceling the order made without the right to any indemnity or compensation.

  • 7. PRODUCT PRICE

The price of the products is that which is indicated at all times on the Website. The price will always be in Euros. VAT or applicable taxes will be applied to the prices. The expenses will be itemized separately, such as, for example, the shipping costs, if any, or, if they cannot be calculated in advance, the User will be informed of it.

The price of the product also includes the first professional assembly of the product if it is required as specified in the description of the product itself.

Likewise, the sale prices of the bases include the necessary accessories to be able to make normal use of them (depending on the model, legs and/or union plates and/or lateral supports). Note that, depending on the product, the accessories may not be reflected in the orders as additional references.

Jack Beds reserves the right to modify a price if it detects that there is a material error in its indication, even after receiving the purchase offer from a User. In this case, he will notify the User so that he can decide if he wants to continue with the order or cancel it.

Any expense associated with the purchase of a product, such as shipping costs or the use of a particular means of payment, will be indicated during the purchase process and, in any case, the User must confirm their acceptance. before finalizing the order.

Note that the prices of Jack Beds products, services and transport are exclusively applicable in the Peninsula (free first delivery) and the Balearic Islands (€39 first delivery, VAT included). Other destinations (Canary Islands, Melilla, Ceuta or International) according to study and previous budget, acceptance of the same and full payment in advance.

  • 8. PRODUCT WITHDRAWAL COST

The costs of removing an old item from the User is included in the price of the items sold by Jack Beds unless otherwise indicated on the Website itself.

For these purposes, the User must give an adequate description regarding the characteristics of the old item to be removed so that Jack Beds can assess whether it is necessary to apply any additional surcharge.

The incorrect description of the old item to be removed, as well as its specific characteristics, will incur additional charges for removal and disassembly services.

Once the old products are removed, Users will not have the option to recover them.

The User may request the removal of the old mattress and any support provided that the latter is previously disassembled. Jack Beds removal staff is not responsible for moving the old item or pallet to any other address. The service only includes the withdrawal.

  • 9. PAYMENTS

Users declare and guarantee Jack Beds that they have the necessary authorizations to use the payment method selected at the time of formalizing their order, exempting Jack Beds from any responsibility for unauthorized use or in any illegitimate way.

Payments denied, totally or partially, by the corresponding entity will automatically lead to the cancellation of the order.

Likewise, any incident derived from the payment of the price will be a reason for not proceeding with the delivery and/or, where appropriate, the assembly, removing the product from the place of delivery if it has already been delivered or canceling the transport if the product was in delivery process.

In these last two cases, the parties must arrange a second delivery which, in any case, will be free, and will be assigned based on the logistical availability of the Jack Beds transport staff. In the case of needing a third delivery, a surcharge of €29, VAT included, will be applied to this.

Payment by bank card (credit or debit)

In the case of selecting payment by card, we inform you that our Website is equipped with security tools that meet the highest market standards such as SSL (Secure Socket Layer) encryption that guarantees security, integrity and confidentiality. of bank details when they travel over the Internet. Therefore, we have measures in place to protect the confidentiality of all communications established during the transaction.

In particular, payments by bank card are processed by the payment gateway STRIPE, which applies appropriate security measures to carry out online payments.

These payments are subject to verification and authorization by the issuing bank of the cards.

At Jack Beds we do not have access to the confidential information of the cards.

Payment by bank transfer

Jack Beds will reserve orders placed by bank transfer for a period of (6) business days from the confirmation of the order by Jack Beds. If after this period, Jack Beds has not received payment of the price, the order will be automatically cancelled.

In any case, the User will be responsible for the correct introduction of the data to make the transfer, including any reference or concept that Jack Beds may indicate during the purchase process. In the event of an error, Jack Beds will cancel the order due to the impossibility of verifying and validating the payment of the order.

Payment in installments through Cofidis

Aplazame allows Users to split the payment of their purchase through a loan. For more information, you can visit the Cofidis website. Where appropriate, Users must sign a contract with Aplazame in accordance with the conditions applicable to the service offered by this financial institution.

Cash on delivery

Payment in cash at the time of receiving the product. No product will be delivered without such payment.

  • 10. INVOICE

In the event that the User wishes an invoice, he must request it from administracion@jackbeds.com.

  • 11. DISCOUNTS AND VOUCHERS

The discount offers, codes and coupons will be valid as long as they are used during the term of validity and respecting the conditions for their use (for example, minimum amount, accumulation of discounts, nominal use, etc.).

These discounts may in no case be reimbursed to the User. Unless expressly excepted, no discount will be cumulative with another discount or discounted product. The discounts will not be transferable to other people and their commercialization is prohibited.

The vouchers must be used in a single order. If the order is less than the amount of the voucher, the User will lose the right to use the difference in other purchases. If the order is bigger or is greater than the amount of the voucher, the User will pay the difference. The vouchers will not be transferable to other people and their commercialization is prohibited.

In particular, but without limitation, coupons of €100 or more will not be cumulative with other discounts and will only be applied to purchases of amounts greater than €500, VAT included.

  • 12. PRODUCT AVAILABILITY

The products on the Website are subject to availability. Jack Beds will do its best to indicate availability on the Website itself. However, the User must take into account that there may be small temporary imbalances between the actual availability of stock and what is indicated on the Website. In this case, he will notify the User so that he can decide if he wants to continue with the transaction or cancel it.

  • 13. SHIPPING POLICY

Place and deadlines

Shipments/deliveries are only made to addresses within the territory indicated in section 3 of these Conditions of Sale.

Unless otherwise indicated, the delivery times indicated on the Website are computed from Monday to Saturday and may be altered by holidays.

Thus, the terms vary depending on the product and quantity requested as reported during the purchase process. Thus, between 7 and 10 business days are expected for all products depending on geographical destination and time of purchase (day and time).

Jack Beds reserves the right to change delivery times. No shipments will be made to post office boxes.

During the purchase process, the approximate delivery times are indicated. Jack Beds will do its best to comply with them. However, transportation is subject to factors beyond the control of Jack Beds.

Cancellation due to delay

In your case, Users may cancel an order if, after thirty (30) calendar days from the confirmation of the order by Jack Beds, the User has not received the products for reasons attributable to Jack Beds.

Absence at home and expenses for second delivery and storage

The absence at the address indicated by the User will in no case be a valid cause to cancel an order after the aforementioned period has elapsed. In case of absence, the User must follow the instructions of Jack Beds to proceed with the delivery of the product in subsequent attempt(s).

These subsequent delivery attempts after the first attempt will entail an additional cost for the User: €29, VAT included, for mattresses, bases. Jack Beds will not be responsible for any damage to the product resulting from a delay in delivery attributable to the User.

In this sense, note that the firm orders that must remain stored in the facilities of Jack Beds or third parties due to the impossibility of being delivered to the User, either because they are not at their home on the day agreed for the delivery, incident in the payment process, improper return of the order, etc. (list of assumptions not being limiting of them), they will remain a maximum of 3 months, after this period, the firm order will be canceled and the amount delivered on account (partial or full) will be withheld as damages.

In the event that the User requests the delivery of the firm order again or picks it up personally, Jack Beds may apply a surcharge to the User for each day of storage of the same as damages; in addition to the corresponding costs for second deliveries, if applicable.

Issue and order tracking

In the initial phase of product dispatch, the User will receive notifications or communications from Jack Beds to track the order placed.

In those orders that require delivery and professional assembly, Jack Beds will contact the User in advance to set a specific time slot for delivery and assembly. And on the same day of delivery, Jack Beds will contact the User to remind him of the time of delivery of his order.

The other shipments are made by traditional courier, in these cases, when placing their order, Jack Beds recommends that Users indicate in it the optimal time slot desired, to the extent of their organizational possibilities, our logistics collaborators They take it into account when planning routes.

Delivery limitations

Users must report those architectural or structural barriers that, in consideration of the measures of the products purchased, may prevent or hinder delivery to the User's address.

Users must pay special attention to these limitations when your orders include non-removable bases and/or folding canapés tops (without flexibility and dimension(s) incompatible with certain accesses).

On the contrary, note that the mattresses delivered packed in boxes of special dimensions and “vacuum-packed” allow delivery in any room with standard access in terms of corridors and door dimensions. However, once unpacked, the removal of said products may be impossible or require special means that will be the responsibility of the User.

Jack Beds reserves the right to deliver the agreed order at street level and thus fulfill its delivery obligation, if it is found impossible to deliver it within the User's home as a result of the architectural barriers of the property, not informed or improperly informed.

In these cases the assembly service will not be carried out, which does not grant the User any right to claim or compensation. If the User does not accept the delivery at street level, a second delivery will be planned as long as it is technically possible, and the User will be responsible for the additional delivery and assembly costs, prior to issuing, accepting and paying the corresponding surcharge budget with the transportation company.

In no case does Jack Beds provide or contract services for the delivery of orders through facades, and the delivery of an order by these means is not its responsibility. Jack Beds, through its logistics collaborators, may put the User in contact with a transport company specialized in deliveries by building facades, as long as the option exists in the delivery area.

Delivery and assembly will be subject to compatibility with current safety, health and risk prevention regulations.

  • 14. RETURN POLICY (WITHDRAWAL)

Deadlines

Whenever applicable in accordance with consumer and user regulations, the consumer User who has purchased a product on the Website may, within a period of fourteen (14) calendar days from the date on which the contract with Jack Beds or as soon as you receive the product or the last of the products ordered in a single order, cancel the contract without having to specify the reason and without incurring any cost (*see the section on conditions and limitations specific hygiene in the case of duvets, pillows and accesories).

Shape

In any case, as a condition of return, the purchased products must be returned in perfect condition and must be returned with the original seal.

To exercise their right of withdrawal, the consumer User must contact Jack Beds Customer Service and inform them of the cancellation of the contract before the expiration of the right of withdrawal. The User must provide the documentation that is required, such as, for example, a photograph of the product, the product model, payment method, a copy of the invoice or purchase receipt or, failing that, the electronic confirmation of the initial order.

Limitations

The User declares to know that some products and/or services are, due to their nature or the characteristics of the applicable sector regulations, excluded from the right of withdrawal, such as, for example, those sealed goods that are not suitable to be returned by reasons of health protection or hygiene and that have been unsealed after delivery or those goods made according to the specifications of the consumer and user or clearly personalized.

Return costs

Users must bear the return costs. Jack Beds will assume the return costs in cases of defective product when the guarantee applies.

Likewise, the User will be responsible for possible extraordinary logistical expenses to proceed with the withdrawal (for example, crane, special means, etc.) of which he will be previously informed.

Collection and return

Jack Beds transport will contact the User to inform about the day and time of collection of the item. After seven (7) business days from the receipt of the returned item in our warehouses and the product checked, the amount will be paid by bank transfer to the account previously indicated by the User and after verifying that the items are in good condition.

Note that the possible additional costs for transport and/or special delivery in the delivery of the initial order are not refundable.

Depreciation for unnecessary handling

Finally, it is important to warn the User that he will be responsible for any depreciation of the products resulting from manipulations that are not necessary to determine the nature, characteristics and proper functioning of the same. The right of withdrawal may not be applied in the following cases:

  1. If the product is not presented in perfect condition.
  2. If the product packaging is not the original or is not in perfect condition. The original packaging must protect the product so that it is received in perfect condition, the use of seals and adhesive tapes applied directly on it being prohibited.
  3. When the product is open without being able to prove that it has not been used.
  4. When they are personalized products or those that, for reasons of hygiene or other legally provided exceptions, are not subject to this right.
  5. Be a custom or clearance item.
  6. This is an order placed in Andorra.

Products acquired with financing

All consequences arising from the acquisition of the order through a financing contract entered into between the User and a financial institution are the sole and exclusive responsibility of the User.

Jack Beds will not be responsible for the financing operations of the products purchased. Any financing operation for the acquisition of Jack Beds products will be carried out outside this company, being a private agreement between the User and the financial entity that he chooses. In no case will Jack Beds act as a lender or as a credit intermediary.

Change 100 days

Notwithstanding the right of withdrawal within the previous fourteen (14) calendar days for mattresses, Jack Beds voluntarily grants the benefit of making a product change if it does not suit the customer's needs for an extra period of another 85 days (100 calendar days in total) for Users to exercise the right to change the product.

The purchase of a mattress of standard sizes (90x190, 90x200, 135x190, 140x200, 150x190, 150x200, 160x200 and 180x200) can be exchanged only once within 100 calendar days of purchase for another model of the same dimensions . The product for which the exchange is made must be in perfect condition, with its original packaging, otherwise, the product may be exempt from the right to exchange. If the mattress chosen for the change is of a lower price than the first, the difference will not be returned and if it is of a higher amount, the user will have to pay the difference. Products with special measures or in liquidation will not admit changes, except for the exercise of the legal guarantee, if applicable.

Orders for Andorra will be exempt from the right to change.

The verification of the origin of the change will be carried out by the Jack Beds team in its warehouses. However, the Jack Beds team could also do the check at the same address in case of detecting damage that prevents the mattress change.

15. WARRANTIES - (G)

G.1. All products offer a 3-year warranty for manufacturing defects from the date of purchase, according to Royal Legislative Decree 7/2021.3.2.

G2. Commercial Guarantee

G.2.1 Only in some of Jack Beds's products is added a progressive amount guarantee extension of 2, 4 and 7 years additional to those established in the previous point (3 years). That is, it covers a total of 5, 7 and 10 years from the date of the product's purchase invoice (see sections 3.3. of application of the warranty). For the extension of the mattresses guarantee to be applicable, these must be installed on a base distributed by Jack Beds or any commercial brand of the company. If not, only the warranty established in point G.1 will apply.

G2.2.2. Commercial warranty 15 years: This commercial guarantee is granted on certain components of the range of rest products made exclusively and personalized for Jack Beds, in case of lack of conformity of the goods. The specific components on which this commercial guarantee is exclusively granted are the following: Missing spring nuclei: you will have a 15-year commercial warranty. In the rest of the add-ons, an additional 7-year guarantee extension will be applied, as mentioned in the previous section G.2.1.

G.3.2. The guarantee of progressive amount will be indicated in the technical file of the product that will be provided in printed format or by email to the customer when making their purchase. Depending on the years of guarantee established in it, the conditions established in the following points will apply.

G.3.3.3. Once the existence of a manufacturing defect has been verified, the product will be repaired or the full replacement of the mattress in case it is in the first 3 years of the warranty. If the purchased model is no longer in manufacture or will not apply the first 3 years of warranty, Jack Beds will proceed to the reimbursement of the proportional amount paid multiplied by percentage (%) established in points G.3.4., G.3.5., G.3.6 and G.3.7., according to the year of guarantee in which it is, in the form of a discount on the purchase of a new mattress.

G.3.4. Products not indicated in the following points will be exempt from the progressive amount guarantee extension, maintaining the guarantee established in point

G.3.5. Products offering a 5-year warranty, warranty coverage will apply as follows: first, second and third year is covered 100%, fourth year is covered 25%, fifth year is covered 15%.

G.3.6. Products offering a 7-year warranty cover as follows: first, second and third year covers 100%, fourth year covers 40%, fifth year covers 30%, sixth year covers 20%, seventh year covers 10%.

G.3.7. Products offering a 10-year warranty cover as follows: first, second and third year covers 100%, fourth year covers 60%, fifth year covers 50%, sixth year covers 40%, seventh year covers 30%, eighth year covers 20%, ninth year covers 10%, tenth year covers 5%.

G.4. Transport and Delivery: The guarantee includes the service of transport of collection and delivery of the product and its repair or, where appropriate, the replacement of the defective product with an equal or equivalent in accordance with the provisions of the previous points. The collection of the product must be in the same direction in which it was delivered. It will be the customer’s responsibility to transport the goods to another home other than the one initially delivered.

G.5. Jack Beds reserves the right to examine the product prior to any repair and to judge the nature or origin of the damage. The guarantee will be valid only when the Jack Beds product is used and handled in accordance with these instructions, and provided that no repairs have been made to the product by persons not authorized by Jack Beds or it is not accredited that the damage suffered in the product has been intentionally caused or as a result of improper or illegal use of it.

G.6. Guarantee Exempts.The following cases will be exempt from warranty:

  • - An increase in the softness of the foam surface.
  • - cracks or marks less than or equal to 3 cm, which arise naturally.
  • - Products with moisture spots that appear after 100 days from product delivery.

When it is a manufacturing problem, these will appear during the first 15-30 days (after 100 days of use they can be due to variable factors external to the product, such as excess humidity in the environment, high sweating or improper use of the mattress).

Depending on the departure of the manufacturing material, slight variations of firmness and irregularities given by the same body of the material can be seen, specifying a period of adaptation in the fibers.

  • - Comfort Preferences.
  • - Unusual or domestic use.
  • - Damages in the mattress as burns, tears, cuts or spots.
  • - Damages or deformations caused by a base in poor condition.
  • - Exposure to cold temperatures causing permanent deformations or tears.
  • - Any incident or claim not made by the original buyer.
  • - Cases in which a defect only involves a small variation or change and does not affect the properties of the mattress.
  • - Any mattress (manufactured or not by Jack Beds) sold by an unauthorized distributor by Jack Beds.
  • - Any mattress that has not been opened within the first month of purchase.
  • - Exposure or second hand or indicating that the mattress is not “new” or “first quality”.
  • - Since the beginning of the mattress use, a normal settlement of the internal layers occurs that oscillates between +0/-2 (UNE-EN 1334:1996). This totally normal circumstance does not entitle any redress or compensation. When products are repaired or replaced under warranty, the original warranty period will not be extended.

G.7. Products are manufactured individually. Therefore, there may be some variations between different products of the same reference.

  • 16. FORCE MAJEURE

Any possible delay or failure to comply with these Conditions of Sale by Jack Beds will not be considered a breach of the same and will be excused to the extent that it has occurred as a result of any cause beyond the control reasonable by Jack Beds, including acts of God, power outages, natural disasters, restrictions by public authorities, inclement weather, strikes, public disturbances, pandemics, outbreaks of previous pandemics or threats of such events.

If thirty (30) days have elapsed from the start of the force majeure event, it persists in such a way that it prevents compliance with these Conditions of Sale, either party may terminate the transaction in question.
